August 8, 2009 | The Hillsider

NEWS RECORD:

The campaign treasurer accused of stealing money from the election fund of a former state assemblyman was admitted into a pretrial intervention (PTI) program over the objections of the state Attorney General’s office.

Rosemary McClave, 66, of Hillside, was indicted on March 23 with one count of third-degree theft by deception and six counts of third-degree tampering with public records. MORE

STAR-LEDGER:

If McClave, who lives in Hillside, successfully completes the program, the charges against her will be dismissed.

[Peter Aseltine, a spokesman for Attorney General Anne Milgram] said it’s not an appropriate punishment for McClave, whose alleged crimes carry a maximum sentence of five years in prison and a $15,000 fine. MORE

WOW! Not one comment so far. Let’s put this story into prospective. The 44 politicians and rabbi’s arrested in the last cooruption probe can cite this case as a reason for no prosecution and no criminal record after PTI. Any politician caught in a corruption probe can cite this case as a president for PTI. It’s a get out of jail free card for all politicians who get caught for the first time. I guess providing the Judge was appointed by close associates to the parties involved. Does anybody think they would get the same deal.
So embessiling over $5,000 as a public official gets PTI and no record.
But in Hillside if your a single mother of two with a 22 yrs. career on the line , you lose your pension and benefits for talking on the phone and eating behind the desk. I guess that’s just what stands for justice in Hillside and Union Co.

I agree w/you Dillon, This person has nine lives or knows where the big bones are buried. I just don’t understand how a person can continue to do things and maneuver herself out. If memory serves she had a similar situation when she worked for Hillside. But that case was settled and sealed. Rosemary your a good one, you can teach classes. Wonder how the Teterboro residents feel about this.

A friend of mine is a former federal prosecutor and I asked his opinion of this case.He stated that Whippal her lawyer is a very expensive and tough hired gun.Contrary to that the state in many cases can be inept. In N.J. he said that for 5 grand you just don’t go to jail and worse yet it is not likely she rolled on Charlotte but not impossible. What would be fair is that she go to trial like any other nit wit without conections.Run the gauntlet like anyone else and have a rap sheet. This case undermines the credibility of the prosecutors office and does make a joke of the system, but if enough people speak out or if Milgrim wishes to send a strong message than an appeal must be filed. It may not be over.

First off she got PTI against the recommendation of the prosecutor so she more then likely didn’t rat anyone. Second she made a mistake and she is being punished by loss of reputation. She is a Hillside person and her Dad was a cop. Both were friends and PTI seems a useful tool in this case although she was wrong. She is unlikely to repeat. This Dillon guy should join the police reserve I am sure he is well qualified to run court where he is from.

Fatal flaw in your thinking.Honor and dignity mean nothing to certain people. Some think the end justifies the means.Start at the beginning and look at all the players whose lives are entwined. They all have one thing in common and it’s whatever they can get.The young or perhaps cynical prosecutors know from experiance how this will play out with a judge so they folded easy.Only an appeal can turn this around and restore confidance in the system.Nobody wants her in jail, just the same treatment everyone else gets.Dillon is no fool, like him or not he knows the system and we both smell a fix.

Adam do you really believe what you said?
How about far treatment for all. You comment the same act and see where you end up. Rosemary’s only concern is that she got over. Does she have to pay restitution, if so how much and how long. If not, she stole and got away with it. In Your Face! As always it’s who you know and the funds to pay.

First of all this woman stole money, and because she committed a white collar crime and her age is supposed to matter and that she’s 66 years of age, we should feel sorry for her is crazy as hell.

if she committs a crime she should do the time no matter what? or who! she know period, this my freinds is called selective prosecution or discrementory bull-sh-t.

if they can lock up the Hobooken Mayor the Assembleyman the Deputy Mayor from Jersey City, Sharpe James who was 70 years old.and they still did not find him gulty on stealing funds. Mims Hackett, from Orange Wayne Bryant from Camdenand the list go’s on and on& on and the still did not get Charlott for her No-Show Job then I guess they dont lock- up old white woman.please give me a brake, the feds are looming for Charlott cant wait for cigs, where there is smoke there is fire.
